Second Edition of Credit Transactions: Notes and Cases

The University of the Philippines College of Law is publishing the second edition of my textbook on credit transactions. Target date of availability at the UP Law Center is January 2016, in time for the second semester, when the course is taught at UP Law.  The Preface to the second edition follows:
Credit Transaction: Notes and Cases is part of the Centennial Textbook Project of the U.P. College of Law.  It is intended as a guide for the course on credit transactions taught at the College.  
Generally, the articles cited in this textbook are the articles of the Civil Code of the Philippines.  When provisions of special laws are cited, the first cited provision is preceded by the title of the special law.  
The provisions of the cited laws are not presented based on article or section number.  Instead they are discussed based on subject matter, and are repeated or excerpted, when necessary, without any change in the actual language of the law, in an effort to aid comprehension.  Moreover, the provisions are reformatted, again without any change in language.  The reformatting, itself an annotation, is intended to emphasize important concepts, clarify meanings, and assist in the understanding of the law.

FLSP Rules

On 21 April 2015, the Supreme Court issued A.M. NO. 15-04-06-SC, adopting and promulgating the Financial Liquidation and Suspension of Payments Rules of Procedure for Insolvent Debtors (2015), or the FLSP Rules.  A juxtaposition of the FRIA and the FLSP Rules is available here.

The UPAA Distinguished Alumni Award for Nationalism and International Law

Last 27 January 2015, IMOA nominated Justice Antonio T. Carpio for the UPAA Distinguished Alumni Award for Nationalism and International Law.  On 20 June 2015, UPAA will officially confer the award on Justice Carpio.


Following is the full text of the nomination letter that I drafted for IMOA:

The Institute for Maritime and Ocean Affairs (IMOA) has the distinct honor to nominate Senior Associate Justice Antonio T. Carpio of the Supreme Court of the Philippines for the UPAA Distinguished Alumni Award for Nationalism and International Law.

Truth be told, Justice Carpio has long deserved this award.  As Chief Presidential Legal Counsel of President Fidel V. Ramos, he was the leading architect of the level-playing-field policy that saw the rise of competition in industries beset by decades-old monopolistic practices.  To this day, the programs and policies that he helped establish continue to have impact, and the most telling illustration of this is in the telecommunications industry.   It was for this and his “distinguished and exemplary service” to the Republic of the Philippines that President Fidel V. Ramos awarded him the Presidential Medal of Merit in 1998.

Maroon Pride, the official magazine of the UPAA for the UP varsity teams, has published its ninth issue - Season of Maroon - to kick-off the 78th season of UAAP, which UP will host.

The Cirillon of IBP Makati

One of the projects of the 2013-2015 Officers and Board of Directors of IBP Makati, under the presidency of Bienvenido I. Somera, Jr., was the relaunch of its newsletter as The Cirillon. I coined the new name from Cirillo, the first name of Past President Doronilla, who founded the newsletter, and carillon, to serve as a clarion call to members of the Chapter to become more active and engaged. The issues of the Carillon may be viewed on IBP Makati.

Introduction of Justice Antonio T. Carpio as Guest Lecturer for Common Ground: An Antiquarian Map Exhibit, at the Lopez Memorial Museum and Library

Excellence is the hallmark of this man's career. 
He was the valedictorian of Class 1975 of the University of the Philippines College of Law. He was the founder of one of the most influential law firms of the country. He was Chief Presidential Legal Counsel to President Fidel V. Ramos and the legal architect of the level-playing-field policy of the Ramos administration. For his "distinguished and exemplary service" to the Republic of the Philippines he was awarded the Presidential Medal of Merit in 1998. 
He is currently a Senior Associate Justice of the Supreme Court of the Philippines and his written opinions are singular examples of legal scholarship and judicial integrity - for one, his ponencia in the People's Initiative case will remain a shining example of adherence to the ideals of the Philippine Constitution.
